Simbu’s Advocate Urges Police To Act Against Real Culprit In Beep Song Matter.....

Advocate Thyageshwaran is the legal counsel for actor " Silambarasan He was born in 1983 in Chennai, Tamilnadu. He is a >> Read More... " in the Beep Song issue, and he shares with us some details about the case.  According to him, 2 FIRs have been filed against Simbu, 1 in Coimbatore Race Course Police Station and one at the Cyber Crime Story soon >> Read More... branch in Egmore, Chennai.  The court has been approached seeking anticipatory bail in these 2 cases.  A few other cases have been filed by private parties in the Magistrate’s Court.

When asked under what legal sections these cases had been filed, Thyageshwaran said that the FIR in Coimbatore mentioned three sections, Indecent Representation of Women’ Prohibition Act 1986, Section 4 & 6, Indian Penal Code, section 509 and Information Technology Act, Section 67.  If Simbu was proved guilty, what would be the punishment meted out to him?  He replied that Section 509 meant two yrs, Sections 4 and 6 meant two years of imprisonment and the IT Act would again attract three years, but he insisted that all these sections were bailable.  He denied any raid on Simbu’s house by the cyber crime department.

Simbu and Anirudh Ravichander The name Anirudh does not need any introduction do >> Read More... have received the summons to appear in court on Jan 4th and are answerable.  On Simbu’s behalf, he had approached the High Court, and their next step would be based on the ruling of the HC.  The Coimbatore Police Station had summoned Simbu on 2nd January, but they had got a postponement that got extended to Jan 4th when there would be a hearing in the HC.  They were still to hear about the new date.

His defence would be that Simbu did not upload, broadcast, publish or transmit the said song anywhere.  So he does not attract the main ingredient of the provision.  Simbu has not made any mistake.  It is quite reasonable in cinema to record songs with dummy words, not meant for release.  The gaps in the general tune here have been filled with cuss words just to spoil his reputation and good name with women.

They had registered a case to cancel the FIR against Simbu, and this is to be heard in Court on 5th Jan 2016.  The original version would be released only if the Court or Police asked for it.  Thyageshwaran and his party had asked the police to find out who released the song with the help of the cyber crime, which would find the IP address.  Once the police do its duty and finds out who did this shameful act, the full details of the case will be revealed to the public.  It remains a secret as to why the police have not yet done this.

Simbu is in TN only; he has not absconded.  The complaint by the Madhar Sangam on Dec 12th was registered by the police the very same day.  But T Rajendher’s complaint of Sunday, 13th Dec was accepted only on 16th Dec.  In this case, their FIR has still not been filed.  They have plans to approach the High Court on this matter also.  Only then will the investigation start.
