has commenced arguments in his appeal hearing and cited 25 state witness statements to vie that there was no evidence that Khan was driving the vehicle.
Desai launch the submissions in the appeal filed by his client opposing the conviction in the hit-and-run case for culpable homicide not amounting to murder and the 5-year sentence granted by the lower court by stating the own case of the prosecution according to the 27 witnesses did not constitute that the actor was driving the vehicle. He was sentenced to 5-years for allegedly killing one and injuring four due to the car crashed that happened on September 28, 2002. The high court suspends his sentence and is now hearing Khan’s appeal.
According to Desai, there is no direct or indirect evidence against his client. He also mentioned that the valet man who saw Khan getting into his car was said to be on duty from 7PM, but Khan was there at 2AM, which means he was not on duty during that time. Another witness also stated that he saw Khan at the Rain Bar in Juhu; however, the actor was not driving.
